Business Identity
These Terms of Service govern your use of services provided by Marathon 360 Ltd, an agent services and marketing technology company serving prime real estate agents and boutique agencies. By engaging our services or submitting your contact information, you agree to these terms.
When you provide your phone number and opt in, you may receive text messages from Marathon 360 Ltd, including service updates, appointment confirmations, billing reminders, and account notifications. SMS recipients are limited to clients of Marathon 360 Ltd under signed service agreement and to individuals who submitted a form on marathon360.co.uk and ticked the SMS consent box.

SMS / Text Messaging — Opt-Out & Support
You can cancel the SMS service at any time. Just text "STOP" to the number from which you received our message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Message Frequency & Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages based on your account activity and the services you have subscribed to; frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Services Scope
Marathon 360 Ltd provides agent services and marketing technology to prime real estate agents and boutique agencies, including:
- Branded CRM portal setup, configuration, and ongoing operation
- AI Employee — multilingual first-responder for calls, WhatsApp, and email enquiries received by the client agency
- Property landing pages, enquiry-capture funnels, and web chat
- Managed advertising on Meta, Google, and LinkedIn
- Multi-channel client follow-up sequences across email, WhatsApp, and SMS
- Account management and monthly performance review
SMS is used only to communicate with clients of Marathon 360 Ltd and with individuals who have submitted a form on marathon360.co.uk and ticked the SMS consent box.
Ordering and Payment
Orders are confirmed upon receipt of payment and signed agreement. All prices are in GBP unless otherwise stated. Payment terms are typically payment in advance unless alternative arrangements are agreed in writing.

Client Responsibilities
Clients must:
- Comply with all applicable data protection laws (UK GDPR, EU GDPR, PDPL, CAN-SPAM, TCPA, and equivalent regimes in their market)
- Use the Marathon 360 platform and any data held within it in accordance with their own privacy policies and legal obligations
- Maintain appropriate licences for their real estate activities
- Not engage in unsolicited marketing or messaging that violates anti-spam law or carrier policy in their jurisdiction
Clients must not:
- Use the platform to send unsolicited communications or for any purpose not agreed in the service agreement
- Reverse-engineer, resell, or sublicense access to the Marathon 360 platform without written consent
- Engage in harassment or inappropriate contact methods
Data Compliance
All data we hold or process is handled in compliance with GDPR, PDPL, CAN-SPAM, and equivalent regimes. Clients are responsible for their own compliance when using our services.
Liability Limitation
Our liability for any claims arising from our services is limited to the total contract value paid for the specific service giving rise to the claim. We exclude liability for indirect, consequential, or special damages.
Intellectual Property
All methodologies, algorithms, and proprietary processes remain the intellectual property of Marathon 360 Ltd. Clients receive a non-transferable licence to use the Marathon 360 platform and any related deliverables for the contracted purpose, but not to reverse-engineer our processes or systems.
Termination
Either party may terminate the agreement with written notice. Upon termination, clients retain ownership of data held within their CRM portal for export, but must cease using our systems, platforms, and ongoing services.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

Changes to Terms
We may update these terms from time to time. Material changes will be communicated to existing clients with reasonable notice. Continued use of our services constitutes acceptance of updated terms.
