Business Identity

These Terms of Service govern your use of services provided by Marathon 360 Ltd, an agent services and marketing technology company serving prime real estate agents and boutique agencies. By engaging our services or submitting your contact information, you agree to these terms.

Our services are supplied to businesses acting in the course of their trade — licensed agents, brokerages, and agencies — and are not offered to consumers. Consumer cooling-off and cancellation rights do not apply to a business-to-business engagement.

When you provide your phone number and opt in, you may receive text messages from Marathon 360 Ltd, including service updates, appointment confirmations, billing reminders, and account notifications. SMS recipients are limited to clients of Marathon 360 Ltd under signed service agreement and to individuals who submitted a form on marathon360.co.uk and ticked the SMS consent box.

SMS / Text Messaging — Opt-Out & Support

You can cancel the SMS service at any time. Just text "STOP" to the number from which you received our message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message Frequency & Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages based on your account activity and the services you have subscribed to; frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Free Trial

We may offer prospective clients a free trial before any paid engagement, at our discretion. Any free trial, sample leads, or evaluation access is provided "as is", for evaluation purposes only, and without warranty or guarantee of any kind. Sample or trial leads are illustrative of the type and quality of enquiry we source and are not a promise of specific volume, conversion, or transaction value. We may vary, suspend, limit, or withdraw a free trial at any time without notice or liability. No fee is charged for a free trial and, accordingly, no refund arises in respect of it.

Ordering and Payment

Orders are confirmed upon receipt of payment and signed agreement. All prices are in GBP unless otherwise stated. Payment terms are typically payment in advance unless alternative arrangements are agreed in writing.

Fees and No Refunds

Because every client is offered a free trial to evaluate the service at no cost before paying, all fees for paid engagements are non-refundable once a service agreement is signed and payment is made. Setup work begins immediately and is performed up front. This does not affect any statutory right that applies to you in the event you contract as a consumer rather than in the course of a business. No Guarantee of Results

Marathon 360 Ltd provides leads, technology, and managed services. We do not guarantee any specific number of enquiries, appointments, viewings, sales, commission, or revenue. Outcomes depend on factors outside our control, including market conditions and the client's own pricing, responsiveness, and sales execution. Any figures, samples, or examples we provide are illustrative only and are not a warranty, forecast, or contractual commitment.

Data Compliance

All data we hold or process is handled in compliance with GDPR, PDPL, CAN-SPAM, and equivalent regimes. Clients are responsible for their own compliance when using our services.

Warranties and Disclaimers

Our services are provided with reasonable care and skill. Except as expressly stated in a signed service agreement, and to the fullest extent permitted by law, all other warranties, conditions, and terms — whether express or implied by statute or otherwise — are excluded. The platform and any leads are otherwise provided "as is" and "as available".

Liability Limitation

To the fullest extent permitted by law, our total aggregate liability for any and all claims arising out of or in connection with our services — whether in contract, tort (including negligence), misrepresentation, or otherwise — is limited to the total fees actually paid by the client for the specific service giving rise to the claim in the three months preceding the event giving rise to the claim. We exclude all liability for indirect, consequential, or special losses, and for any loss of profit, revenue, business, goodwill, or anticipated savings.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Indemnity

The client agrees to indemnify and hold harmless Marathon 360 Ltd against all claims, losses, liabilities, and costs arising from the client's use of the platform or leads, the client's own marketing or contact practices, or the client's breach of these terms or of any applicable law, including data protection and anti-spam law in the client's market.

Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages or changes at third-party platforms (such as Meta, Google, LinkedIn, WhatsApp, or telephony carriers), internet or hosting failures, changes in law, or acts of government.

Intellectual Property

All methodologies, algorithms, and proprietary processes remain the intellectual property of Marathon 360 Ltd. Clients receive a non-transferable licence to use the Marathon 360 platform and any related deliverables for the contracted purpose, but not to reverse-engineer our processes or systems.

Termination

Either party may terminate the agreement with written notice. Upon termination, clients retain ownership of data held within their CRM portal for export, but must cease using our systems, platforms, and ongoing services.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

Changes to Terms

We may update these terms from time to time. Material changes will be communicated to existing clients with reasonable notice. Continued use of our services constitutes acceptance of updated terms.
